Terms and Conditions
The terms that apply when you use this site or engage us for work.
These terms govern your use of this website and, where stated, our services. The date at the foot of this page shows when we last updated them.
About us
Best Web Developer operates this site from 18 Lyme Road, Leicester, LE2 1QE, United Kingdom.
Using this website
By using this site you accept these terms. If you do not accept them, please do not use the site.
We may update the site and these terms at any time. We try to keep information accurate and current but make no guarantee that it is complete or error-free.
Intellectual property
Unless stated otherwise, the content of this site, meaning text, design, graphics, code and layout, belongs to Best Web Developer or is used with permission. You may view and print pages for your own reference. You may not republish, sell or systematically reproduce the content without written permission.
Our services
Information about services on this site is not a binding offer. A separate written proposal and agreement governs any engagement, setting out scope, deliverables, timescales and price. Where those documents conflict with these terms, those documents take precedence.
Quotations
Quotations hold for 30 days unless we say otherwise, and follow the scope the proposal describes. We quote work outside that scope separately, and it needs your approval before it begins.
Payment
Each proposal sets out its payment terms. We typically invoice projects against milestones. We invoice retainers monthly in advance. Invoices are payable within 14 days unless agreed otherwise. We may suspend work on overdue accounts.
Client responsibilities
Timely delivery depends on receiving content, feedback and approvals from you within agreed timeframes. Delays on your side may move the delivery date. You confirm that any materials you supply do not infringe third-party rights.
Ownership of work
On full payment, intellectual property in the deliverables created specifically for you transfers to you. We retain ownership of any pre-existing tools, libraries or components used, and grant you a perpetual licence to use them as part of the deliverables.
We may reference the work in our portfolio unless you ask us not to.
Third-party services
Projects may rely on third-party services such as hosting, payment gateways or analytics. Those services carry their own terms, and we take no responsibility for their availability or performance.
Liability
Nothing in these terms excludes liability for death or personal injury arising from negligence, for fraud, or for anything else that cannot lawfully be excluded.
Subject to that, we are not liable for indirect or consequential loss, loss of profit, loss of business or loss of data. Our total liability for any engagement never exceeds the fees you paid for that engagement.
Search rankings and results
We do not guarantee specific search rankings, traffic volumes or business results. Search engines and advertising platforms control their own systems and change them without notice. We commit to an agreed scope of work and transparent reporting, not to outcomes outside our control.
Termination
Either party may end a monthly retainer with 30 days written notice. For fixed-scope projects, the relevant proposal sets out the termination terms. Fees for work completed up to termination remain payable.
Governing law
The law of England and Wales governs these terms, and the courts of England and Wales hold exclusive jurisdiction.
